TERMS AND CONDITIONS

 

1. Definitions

    • “Snoozy Rentals” (“we”, “us”, “Snoozy Rentals”) means Snoozy Rentals Pty Ltd (ABN 90 651 437 437) or any person acting on behalf of and with the authority of Snoozy Rentals Pty Ltd (ABN 90 651 437 437).
    • “Customer” (“client”, “user”, “you” or “your”) means the individual who is hiring the Snoo supplied by Snoozy Rentals and accepts the Terms and Conditions (by checking the box that states that the customer accepts) of hiring the item. Customers must be older than 16 years of age.
    • “Snoo” (“Snoo) means the goods supplied by Snoozy Rentals to the Customer.
    • “Business Day” means any day of the week excluding Saturday, Sunday and Australian public holidays.
    • “Damage” (“damages”,”damaged”) means any damage including, but not limited to, a stain, mark, tear, discoloration/changes to original colour, faultiness, caused to the Snoo during the Hire Period, whilst in the possession of the Customer.
    • “Debt Collectors” means any insurer or solicitor/barrister, which Snoozy Rentals has appointed to collect outstanding fees owed by the Customer.
    • “Pickup Date” means the date in which the Customer picks up / collects the Snoo from Snoozy Rentals.
    • “Hire Period” means the duration between the Pickup Date and Return Date.
    • “Hire Fee” means the cost to hire the Snoo for the Hire Period.
    • “Payment”/“Payment Card” means Mastercard or Visa credit card.
    • “Penalty Fee” means any amount owing for; a stolen, missing or damaged Handbag and/ or the Handbag being returned after the Return Date.
    • “Personal Details” means any personal information which include but is not limited to copy of driver’s license, passport or identification card, full name, date of birth, address, phone number, email and payment card details, which the Customer has registered onto Snoozy Rental’s website.
    • “Return Date” means the date by which the Customer physically returns the Snoo to Snoozy Rentals.
    • “Third Party” means anyone other than Snoozy Rentals and the Customer – this includes, but is not limited to a friend, family member, acquaintance or unknown persons.
2. Agreement
    • An Agreement of Hire is formed once the Customer accepts the Terms and Conditions and makes payment of the Hire Fee.
    • The Agreement of Hire subsequently binds the Customer and Snoozy Rentals to the accountability of the Terms and Conditions.
    • The agreement of hire is ceased once the item is returned.
3. Orders and Payment
      • Snoozy Rentals accepts orders from within Australia only.
      • All customers booking an item for rent are required to create an account for security purposes. This account requires…the following information
        • Name
        • Billing address
        • Photo ID
        • Payment method
      • After the acceptance of the Terms and Conditions, the customer is directed to make payment of the hire fee via credit card (Mastercard, Visa) or PayPal. The applicable fees will be charged on the date the purchase is made.
      • You will be required to provide Snoozy Rentals with accurate and valid credit card details, PayPal account, and driver’s licence, or other accepted form of photo ID.
      • This credit card will provide cover for the entire scope of the Terms and Conditions, including potential fees associated with damages, theft, late return and cancellations.
      • Snoozy Rentals takes no responsibility for any associated fees issued by your financial institution.
      • All prices are in Australian Dollars (AUD).
    4. Cancellation
        • Cancellations must be made by contacting the customer service team.
        • At their sole discretion Snoozy Rentals may cancel these Terms and Conditions, by giving written notice. Snoozy Rentals will repay any fees paid by the customer. Snoozy Rentals will not be liable for any loss or damage incurred to the customer as a result of cancelling the order.
      5. Damages
          • If the item is returned with damages that exceeds normal wear and tear, Snoozy Rentals reserves the right to bill the customer the cost of repairing the item.
          • A Penalty fee may be charged to cover any lost earnings due to damages that require repairing.
          • A tax invoice will be emailed to the customer, billing any extra incurred costs. Snoozy Rentals, will bill the nominated credit card 24 hours after the issue of the tax invoice.
          • In the instance the credit card cannot be billed, Snoozy Rentals will contact the customer to organize a suitable alternative, including a repayment plan.
        6. Stolen or Unreturned goods
            • In the event that the item is stolen or unreturned, the customer will be responsible to repay Snoozy Rentals the full replacement value of the item.
            • In assessing the replacement value, Snoozy Rentals will take into account the condition of the item and the availability to re-purchase the item.
            • In the instance the credit card cannot be billed, Snoozy Rentals will contact the customer to organise a suitable alternative, including a repayment plan.
            • Snoozy Rentals reserves the right to pursue legal action and to pass on details of the customer to the Police and/or debt collection agency for prosecution.
          7. Pickup
              • The Pickup date is recorded when the customer collects the Snoo from Snoozy Rentals business address being, 7 Way Avenue Myrtle Bank SA 5064
              • Any pickup date given by Snoozy Rentals to the customer is an estimate only. Snoozy Rentals will not be liable for any loss or damage incurred to the customer as a result of pickup being late.
              • The customer is required to inspect the item within twenty-four (24) hours of pickup and inform Snoozy Rentals of any damage or failure to comply with the expected standard of the item.
            8. Returns
                • The return date is the final date of the booked period.
                • The return date is recorded when the customer returns the Snoo to Snoozy Rentals business address being, 7 Way Avenue Myrtle Bank SA 5064
                • It is the responsibility of the customer to re-package the items as directed by Snoozy Rentals’s return instructions. These instructions are:
                  • Re-package the Snoo and all accessories and manuals in the original dust cover that was supplied on pickup.
                • The customer will be charged a minimum late fee of $10 for each late business day, until the item is returned to Snoozy Rentals.
                • A tax invoice will be emailed to the customer, billing any extra incurred costs. Snoozy Rentals, will bill the nominated credit card 24 hours after the issue of the tax invoice.
                • In the instance the credit card cannot be billed, Snoozy Rentals will contact the customer to organize a suitable alternative, including a repayment plan.
              9. Customer’s Responsibilities
                  • The Customer shall:
                    • Not hire the item to a third party.
                    • Not leave the item in the care of a third party.
                    • Notify Snoozy Rentals of any damage to the item that occurs during the agreement.
                    • Ensure that the item is not lost or stolen by themselves or a third party.
                    • Not attempt to clean or repair the item themselves.
                    • Return the item in accordance to Snoozy Rental’s re-packing instructions.
                    • Return the item by the agreed return date.
                    • Pay any penalty fees that are incurred over the course of the agreement.
                10. Intellectual Property
                    • Snoozy Rental’s visual and promotional assets, including any graphics, logos, web design, button icons, photographs, video, images and software are the property of Snoozy Rentals and protected by Australian and International copyright laws.
                    • No material, not limited to the list above, should be reproduced without written consent from Snoozy Rentals.
                  11. Gift cards
                      • Customers can buy gift cards for themselves or third parties, redeemable on the Snoozy Rentals website to the amount the gift card was purchased.
                      • A Snoozy Rentals customer account is not required to purchase a gift card
                      • The customer who redeems the gift card will need a registered Snoozy Rentals account with credit card details to cover damages to, theft and/or lost Snoos.
                      • The customer who redeems the gift card are bound to the Terms and Conditions and will be liable for any damages to, theft or lost Snoos.
                      • All gift cards are issued with an expiry date exactly 3 years after purchase. The gift card will not be redeemable after the gift card expiry date.
                      • Money left over from a partially redeemed gift card will be available on the customers account until the expiry date of the gift card.
                    12. Promotions
                        • Snoozy Rentals will issue promotional codes.
                        • These codes will offer customers a discount on Snoo rental
                        • Snoozy Rentals reserves the right to stop promotions and cancel promotional codes at any time after issue without notice given to any customer who received such a promotional code.
